1. Agreement
These Terms of Service (“Terms”) govern your access to and use of the Courtiv website, applications, and platform (the “Service”). By creating an account, accessing, or using Courtiv, you agree to these Terms. If you are using the Service on behalf of a club, company, or other organization, you represent that you have authority to bind that organization.
2. The Service
Courtiv provides tools for sports clubs and venues to manage courts, bookings, tournaments, memberships, CRM, analytics, payments, and related operations. Features may vary by plan and may change over time as we improve the product.
3. Accounts & eligibility
You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account. Club administrators are responsible for managing staff access and for the accuracy of data entered in their workspace.
4. Acceptable use
You agree not to:
- Use the Service for unlawful, fraudulent, or harmful purposes
- Attempt to access another tenant’s data or disrupt Service security
- Reverse engineer, scrape, or abuse the platform beyond normal use
- Upload malicious code or content that infringes others’ rights
- Misrepresent your identity or affiliation when using Courtiv
We may suspend or terminate access for violations of these Terms.
5. Club content & data
Clubs and users retain ownership of the content and operational data they submit to Courtiv (“Customer Data”). You grant Courtiv a limited license to host, process, and display Customer Data solely to provide and improve the Service. You represent that you have the rights needed to submit Customer Data, including member and player information.
6. Bookings, memberships & payments
Clubs are responsible for their pricing, availability, cancellation policies, and fulfillment of bookings, memberships, and tournaments. Payments may be processed by third-party payment providers. Fees for Courtiv subscriptions, if any, are described at the time of purchase or in a separate order form. Unless stated otherwise, fees are non-refundable except where required by law.
7. Third-party services
The Service may integrate with third-party tools (for example payment processors or maps). Your use of those services may be subject to their own terms and privacy policies. Courtiv is not responsible for third-party services outside our control.
8. Intellectual property
Courtiv, including its software, branding, logos, and design, is owned by Courtiv and its licensors. These Terms do not grant you any right to use Courtiv trademarks except as needed to identify your legitimate use of the Service.
9. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Service, you acknowledge that policy.
10. Availability & changes
We aim to keep Courtiv reliable but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features with reasonable notice when practicable. We may update these Terms by posting a revised version on this page. Continued use after the effective date constitutes acceptance.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COURTIV AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO COURTIV FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.
13. Indemnity
You agree to defend and indemnify Courtiv against claims arising from your use of the Service, your Customer Data, or your violation of these Terms or applicable law.
14. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or if required for security or legal reasons. Upon termination, your right to use the Service ends. Provisions that by nature should survive (including intellectual property, disclaimers, and liability limits) will survive.
15. Governing law
These Terms are governed by the laws applicable to Courtiv’s principal place of business, without regard to conflict-of-law principles, unless mandatory local consumer law provides otherwise.
